Terms and Conditions

Burlington Live Speaking™️ is an online education service provided for the development of the Student’s English speaking and effective communication skills (the “Service”).

Here follows the contractual terms that will apply to the supply of the Service (the “Contract”) between us (the “Provider’), and you (the “Customer”, or “Parent”, if applicable) and/or a child under legal age who is enrolling for the Burlington Live Speaking™️ course (the “Student):

Article-1: Purpose of the Contract

The purpose of this Contract (which is concluded electronically) is to develop the speaking and effective communication skills of the Student in English.

Article-2: Conditions for the Provision of the Service

2.1. The Student will receive the Service subject to this Contract through the Burlington Live Speaking™️ education platform via entry into a virtual classroom. The connection to the Burlington Live Speaking™️ platform in English will be made through the video conference platform to be determined by BEC and notified to the Customer.

2.2. The Student will be given a personal activation code or username and password to gain access to the video conferencing platform. It is the responsibility of the Student and the Customer to keep this code secure.

2.3. The lessons will be provided via the video conference platform; It is the responsibility of the Customer to ensure that the minimum audio, video and internet quality requirements listed in Appendix I below for the Student to actively attend the lesson are provided. BEC shall not be responsible if the Student is unable to attend the lesson due to a problem caused by his/her own audio, video and internet quality, and if such a problem occurs, no claim can be brought against BEC.

2.4. The Student agrees to act in accordance with the rules and instructions determined by BEC, both those specified in this Contract and any additional rules or instructions to be notified by BEC to the Customer and/or the Student.

2.5.  The Customer declares that she/he understands and accepts that in order to ensure the content and quality of the lesson, Students are obliged to keep their cameras and microphones on throughout the lesson. In the event that the Student acts contrary to these rules he may be removed from the lesson, and the Customer cannot demand from BEC any refund.

2.6. The Student may not disrupt the lesson or by his/her behaviour disturb the teacher and/or other Students in the class. In the event that the Student violates these rules the Customer declares he/she understands and accepts that;

2.6.1. The teacher may apply all kinds of appropriate measures (such as verbal warning, expulsion from the lesson etc), in order to ensure provision of uninterrupted Service and protect the right of other Students, and such measures will not constitute a violation of the Contract,

2.6.2. The Customer cannot demand from BEC any refund or make any other claims if the Student is prevented from participating due to the violation of these rules.

2.7.  It is strictly forbidden for the Student to make another person benefit from the Services by providing such person with his/her Activation Code or user name and password. If this is discovered, the Contract will be terminated by BEC, with no refund.

2.8. The Student cannot attend the course of another class other than his/her own. In the event that the Student attends a class other than the one specified for him/her, he/she will be designated as “Absent/Did not attend the course” in the attendance of records of the course assigned for him/her.

2.9. The Student will attend at the pre-announced course hours. Follow-up of the course schedule is the responsibility of the Customer and the Student. Missed lessons will not be compensated, no fee will be refunded to the Customer and no claim can be made against BEC.

Article-3: Rights and Obligations of BEC

3.1. Classes will be held on the hours and days designated by the Student’s school or service provider, as relevant. The time of the lessons will be announced to the Student by the school or service provider.

3.2. BEC has the right to determine the number of Students who will attend the course.

3.3. In the event that any of the lessons in a course to be given under this Contract are not provided for any reason caused by BEC, the missed lesson/s may be added to the end of the course.

3.4. BEC may contact the Parent to report on the Student’s attendance and performance reports.

Article-4: Payment

4.1. The Customer will pay the fee determined in advance for the Service via the payment page.

4.2. Payments will be made by credit card at the time of conclusion of the Contract, through the payment system to be notified by BEC, by single payment.

4.3. The Student cannot start using the Service without this fee being paid.

4.4. The Student’s inability to attend the lesson/lessons for reasons related to him/her does not entitle a refund of any of the fee. BEC shall be deemed to have fulfilled its contractual obligation by keeping the Service available for performance in accordance with the Contract.

Article-5: Other Provisions

5.1. BEC undertakes to keep the confidential information and personal data provided to it strictly private and confidential, and to take all necessary measures and to exercise all the necessary care to ensure and maintain confidentiality, to prevent all or any part of the confidential information from being disclosed to the public or to an unauthorized user or a third party.

5.2. The personal data provided by the Customer cannot be used for any purpose other than those specified in this Contract and the  Privacy and Data Protection Notice.

5.3. The Customer has the right to withdraw from this Contract within fourteen days from the conclusion of the Contract without giving any reason and without paying penalty clauses. It is sufficient that the notification of the exercise of the right of withdrawal has been sent to BEC within this period. You may send the notification of the right of withdrawal by e-mail to info@livespeaking.com. The Contract cannot be cancelled or postponed by the Customer after the fourteen-day withdrawal period. After the expiry of the fourteen-day withdrawal period, no refund will be given.

5.4. This Contract shall be governed by and construed in accordance with the Laws of the Republic of Cyprus. The Courts of Limassol and their execution offices are authorized to act in all disputes arising out of or in connection with this Contract.

5.5.   This Contract enters into force on the day of payment by the Customer.

Explicit Consent Declaration

I, the Customer, hereby consent to share with BEC, under the conditions described in the Privacy and Data Protection Notice, my personal data and the personal data of the Student that I am the guardian of, for the purposes of providing the Services, this being necessary for the functioning of the Service infrastructure and information systems, and this Explicit Consent Declaration allows for the above personal data to be processed and stored in such electronic media.
